"Member" means a person joining by an application for the registration of a co-operative society which is subsequently, registered or a person duly admitted to membership of society after registration.

Conditions for Membership

An individual who is eligible to be a member and who has applied for membership of the Society in the prescribed form may be admitted as a member by the committee on complying with the following conditions:

No person shall be member unless:

(a) She/he is substantively employed in “ARMED FORCES HEADQUARTERS, in Civilian Cadre on regular employment.          

(b) His/her written application of membership has been approved by the Managing Committee;

(c) She/he is competent to contract under section 2 of the Indian Contract Act, 1872;

(d) She/he is not a member of any Primary Society dispensing credit with limited or unlimited liability;

(e) He has carried out the provisions of Bye-laws 11;

(f)         (i) Every member on admission shall pay Rs. 500/- as admission fee which shall not be refunded in any case;

            (ii) When a person’s application for membership has been accepted by the Managing Committee and he has paid his admission fee and share money, he shall be deemed to have acquired all the rights, incurred all the obligations as laid down in the Act and Rules made there under and these Bye-laws.

Benefits for Membership

Cessation of membership of Cooperative Society.

(1) Notwithstanding anything contained in this Act, a person shall cease to be a member of a cooperative society -

(a) on his resignation from such membership; or

(b) on his death, if there is no claim by the nominee or legal heirs within three hundred sixty five days; or

(c) on transfer of the whole of his share or interest in that cooperative society; or

(d) on his expulsion or incurring any disqualification for being a member of that cooperative society.

(2) If any question as to whether a member has incurred any of the disqualifications mentioned in sub-section(1), it shall be referred to the Registrar for his decision, whose decision shall be final and binding.

(3) A member of the Society may be expelled by a 3/4th majority of the Managing Committee members present at the Managing Committee Meeting.

  1. If he makes default in the payment of his instalment of loan;
  2. if he has applied to be adjudicated as insolvent or is an undischarged insolvent;
  3. if he has been sentenced for any offence other than an offence of a political character or an offence involving moral turpitude and dishonesty; or
  4. if he undertakes an profession similar to the objects of the Society; or
  5. if he intentionally does any act likely to injure the credit of the society or fails to observe proper discipline in regards to the work of the Society;
  6. For any action which may be held by the Managing Committee to be dishonest or contrary to the stated objects of the Society or to the interest of cooperatives.
  7. Incurs any of the disqualifications as contained in Rules
    1. Opportunity shall be given to a member before expulsion from membership to represent his case to the Managing Committee and expulsion shall not be effective unless it is approved by the Registrar.

(4) The Registrar may of his own motion, if satisfied that any member has incurred any of the disqualification under sub-section (1) declare through an order in writing that such member is disqualified to be a member :

Provided that no such order shall be passed without affording opportunity of being heard to such member as prescribed.

Membership

An individual who is eligible to be the member and who has applied for membership of the Society in the prescribed form, may be admitted as member by the committee on complying with the following conditions:

  • Any citizen of India, residing in NCT of Delhi having a sound mind is eligible for the membership of the Society.
  • She/he must have completed age of 18.
  • he has fully paid the value of at least ten shares of the society, along with his application for membership;
  • he has paid the entrance fee of Rs.100/-, along with the application for membership;
  • he has given the application in a prescribed form as prescribed the particulars in regard to any house, plot or flat owned by him or by any of the members of his family, anywhere in the area of operation of the society;
  • he has given an undertaking in the prescribed form to the effect that he shall use the flat for the purpose for which it was purchased by him;
  • he has furnished undertaking in the prescribed form, if he has no independent source of income:
  • he has sent, along with the application for membership of the society, a certified copy of the agreement, duly stamped entered into by him with the Promoter (Builder) or transferor under Section 4 of the Ownership Flats Act, 1963
  • he has furnished such other undertakings/declarations, in the prescribed forms as are required under any law for the time being in force and such other information as is required under the bye-laws of the society along with the application for membership.

Benefits for Membership

(A) Getting Copy of the Bye-Laws:

A member shall be entitled to receive a copy of the registered bye-laws of the society on payment of the price thereof as per clause 172.

(B) Inspection of Books and Records:

A member shall have right to inspect free of cost books, registers documents etc. as provided in Section 32 (1) of the MCS Act 1960 and get copies of the documents as provided under Section 32(2) of the MCS Act 1960, on payment of the fees prescribed under the bye-law No. 172.

(C) Resignation by a Member:

  • A member may resign his membership after giving three months notice, in the prescribed form to the Secretary of the Society as provided under Rule 21 (1) of the MCS Act, 1961.
  • No resignation of a member of the Society shall be accepted unless such member has made payment of the charges payable to the society in full.
  • Where any charges are found payable by the member of the Society, the Secretary of the society shall intimate the same giving full details and reasons of dues thereof to the member within 15 days of the receipt of the notice of resignation, advising him to make payment thereof within 30 days of the date of the intimation.
  • Where there are no charges of the society outstanding with the member, the Committee shall accept the resignation of the member and the Secretary of the Society shall communicate the same to the member within a period of 3 months from the date of the receipt of the notice of the resignation. If nothing is communicated during the said period, then it shall be deemed that resignation is accepted.
  • Where any resignation is rejected, the Committee shall record the reasons therefor and communicate the same to the member concerned within 3 months of the date of receipt of notice of resignation.
